This Terms of Service agreement ("Agreement") is between BHR Hosting ("Company," "we," "us," or "our") and the person or entity who utilizes our hosting services ("Customer," "you," or "your"). By activating an account or using our services, you agree to comply with all terms outlined herein.
1. SERVICE DESCRIPTION AND PROVISIONING
BHR Hosting provides web hosting, virtual private servers (VPS), dedicated servers, and related domain services.
- Provisioning: Services are typically provisioned within 24 hours of payment verification. We reserve the right to refuse service to anyone for any reason at any time.
- Account Verification: You must provide valid identification and contact information. Use of proxy IP addresses or fake data during registration is grounds for immediate termination.
2. ACCEPTABLE USE POLICY (AUP)
The Customer agrees to use the Services only for lawful purposes. The following activities are strictly prohibited and constitute a material breach of this Agreement:
- Illegal Content: Hosting, distributing, or linking to child sexual abuse material (CSAM), pirated software (Warez), or any material that violates local, state, or federal laws.
- Network Interference: Engaging in DDoS attacks, port scanning, or any activity that disrupts the network integrity of BHR Hosting or any third party.
- Resource Abuse: Excessive use of CPU, RAM, or Disk I/O on shared/VPS environments that degrades performance for other customers.
- Unsolicited Email (SPAM): Using BHR Hosting infrastructure to send unsolicited bulk email. We maintain a zero-tolerance policy for SPAM in accordance with the CAN-SPAM Act.
- Security Threats: Hosting "stressers," "booters," or malware distribution sites.
3. SERVICE LEVEL AGREEMENT (SLA) & UPTIME

Uptime Guarantee: BHR Hosting guarantees a 99.9% monthly network uptime.

Exclusions: Uptime guarantees do not apply to downtime caused by:
- Scheduled maintenance (notified via email or status page).
- Customer-side software configurations or scripts.
- Force Majeure events (natural disasters, war, etc.).
- Third-party upstream provider outages beyond our direct control.

SLA Credits: If uptime falls below the guarantee, Customers may request a service credit equal to 5% of their monthly fee for every hour of downtime, capped at 50% of the monthly fee. Credits are applied to future invoices and are not refundable as cash.
4. BILLING, RENEWALS, AND CANCELLATIONS
- Payment: All services are prepaid. Invoices are generated 7 days before the due date.
- Automatic Renewal: Unless a cancellation request is submitted via the Client Portal at least 24 hours prior to the renewal date, services will automatically renew.
- Late Fees and Suspension: Accounts not paid within 3 days of the due date will be suspended. Data may be permanently deleted from our servers 14 days after the due date. BHR Hosting is not liable for data loss due to non-payment.
- Refunds: We offer a 7-day money-back guarantee for new Shared Hosting accounts only. VPS and Dedicated Servers are non-refundable.
5. DATA BACKUPS AND SECURITY
- Customer Responsibility: BHR Hosting does NOT guarantee the integrity of backups. The Customer is responsible for maintaining their own off-site backups.
- Disclaimer: We are not liable for any data loss, regardless of the cause (hardware failure, human error, or malicious intrusion).
- Security: You are responsible for securing your own scripts and applications (e.g., keeping WordPress and plugins updated).
6. INTELLECTUAL PROPERTY & DMCA POLICY
BHR Hosting complies with the Digital Millennium Copyright Act (DMCA).
- Takedowns: Upon receipt of a valid DMCA notice, we may suspend access to the allegedly infringing material.
- Repeat Offenders: We reserve the right to terminate customers who are repeat infringers of intellectual property rights.
- DMCA Agent: Please send all notices to abuse@bhrhosting.com.
7. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHR HOSTING, ITS EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFIT OR DATA) ARISING FROM THE USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CUSTOMER DURING THE THREE (3) MONTHS PRECEDING THE CLAIM.
8. INDEMNIFICATION
Customer agrees to defend, indemnify, and hold BHR Hosting harmless from any and all demands, liabilities, losses, costs, and claims, including reasonable attorney’s fees, asserted against BHR Hosting that may arise from any service provided or performed or agreed to be performed or any product sold by Customer.
9. TERMINATION
We reserve the right to terminate any account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other customers, BHR Hosting’s business, or third parties.
10. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement is governed by the laws of the State of Illinois, United States. Any legal action or proceeding shall be brought exclusively in the courts of competent jurisdiction located within the State of Illinois.
11. MODIFICATION OF TERMS
BHR Hosting reserves the right to modify these Terms at any time. Changes become effective immediately upon posting to our website. Your continued use of the Services signifies your acceptance of the updated Terms.
By purchasing or using BHR Hosting services, you acknowledge that you have read, understood, and agreed to these Terms of Service.
